Terms of Service

By creating an AdCast account or using the platform, you agree to these terms and to our Privacy Policy.

AdCast is a marketplace platform that connects streamers (content creators) with brands (sponsors) for overlay sponsorship placements delivered through OBS browser sources. We facilitate the agreement, schedule, payment, and reporting; we are not a party to the underlying sponsorship between streamer and brand.

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You are responsible for keeping your password secure. We strongly recommend enabling two-factor authentication.
• One person or entity per account. You may not transfer accounts.
• You must provide accurate registration and profile information.

• You must own or have rights to the streaming channels you connect.
• You must display sponsorships as agreed with the brand and play approved creatives only.
• You must label sponsored content clearly. Our overlay shows a "Sponsored" or "Ad" disclosure on every creative as required by FTC guidelines.
• You must not artificially inflate viewer counts, generate fake impressions, or use bots to influence stream metrics.
• You must complete Stripe Connect onboarding to receive payouts.
• You agree to AdCast's platform fee, set at 20% by default. Promotional or founding-partner accounts may have a different fee, shown in your dashboard.
• You may upload your own promotional creatives ("house creatives") to play through the overlay, subject to admin review.

• You are responsible for the creative content you upload — it must be lawful, accurate, and yours to use.
• All creatives are reviewed before approval. We may reject or remove creatives that violate these terms.
• You set the campaign budget, daily budget cap (optional), pricing model (per stream, per hour, or CPV), and minimum display time.
• Payment is due upon booking completion. We charge a 20% service fee included in the agreed rate.
• If you embed our conversion tracking pixel on your site, you are responsible for disclosing it in your own privacy policy and obtaining any consent your jurisdiction requires.

The following are not allowed in any creative or campaign on AdCast:

• Adult or sexually explicit material.
• Illegal products, services, or activities under applicable law.
• Misleading or deceptive claims, including fake testimonials.
• Hate speech, harassment, or content targeting a protected group.
• Content directed at children under 16.
• Content that violates third-party intellectual property.
• Malware, phishing, or content that links to harmful sites.

We may suspend accounts and remove campaigns that violate this section.

• Platform fee: 20% of every completed booking by default. Founding-partner and promotional accounts may have a lower fee, displayed in your dashboard.
• Streamers receive 80% of the agreed rate (or 100% minus the override fee where applicable), paid via Stripe Connect.
• Brands pay the agreed rate at booking completion. Daily budget caps, when set, halt new spend for the rest of the day once reached.
• Fees and payouts are non-refundable once a stream session has been completed, except as described in §8.

• Either party can file a dispute on a booking from the booking page. The other party is notified and an admin reviews.
• If you can't reach a resolution in-app, contact [email protected] and we will mediate in good faith.
• Refunds: a brand may receive a refund (full or partial) for a booking when an admin determines that the streamer materially failed to deliver. Refunds are recorded in your dashboard with the corresponding Stripe refund ID.
• Streamer payouts may be reversed when a refund is issued for a corresponding booking.

• You can close your account at any time from Settings → Delete my account. Your personal identifiers are scrubbed; financial records are kept per §5 of our Privacy Policy.
• We may suspend or close accounts that violate these terms, with notice where reasonably possible.
• Outstanding payouts due to streamers at closure are processed normally; outstanding balances owed by brands remain due.

• You keep ownership of the content you upload (creatives, profile media). You grant us a non-exclusive licence to host, display, and deliver it through the platform.
• AdCast, our logo, and the platform UI remain our property.

The platform is provided “as is.” To the fullest extent permitted by law, AdCast is not liable for indirect, incidental, or consequential losses. Our total liability for any claim is capped at the amount you paid us in the 30 days preceding the claim.

We may update these terms. Continued use after changes means you accept them. Material changes will be notified by email at least 14 days in advance where reasonably possible.
